Emergency Lighting Terms & Conditions

The following terms and conditions shall constitute the agreement between Emergency Lighting (Seller) and Purchaser with respect to the sale of products by Seller to Purchaser. This Agreement incorporates the product type, quantity and shipment date terms set forth in your electronic or written purchase order. All other terms set forth in the purchase order, including but not limited to terms related to express or implied warranties, are superseded and replaced by these Terms and Conditions. In the event of any conflict between the terms contained in the purchase order and these Terms and Conditions, these Terms and Conditions shall control.

Net invoice amount will be due and payable upon receipt of goods for accounts in good standing. Orders may also be prepaid by Check, Cashier's Check, or Credit Card (Visa, MasterCard, Discover or American Express cards are accepted). Emergency Lighting does not accept COD orders. For your added security, we use encrypted payment systems on our website so no clear text copies of your credit card number are transmitted over the web. We reserve the right to require a deposit of up to fifty percent (50%) of the order value for all orders over one thousand dollars ($1,000) before beginning production. A late charge of one and one-half percent (1.5%) per month, eighteen percent (18%) per year, will be applied to account balances not paid in accordance with these terms.

Account balances still owing six (6) months after delivery of goods will be declared delinquent and Emergency Lighting reserves the right to take any and all collection steps, as we in our sole discretion deem necessary or appropriate, to collect the delinquent balance, up to and including any and all appropriate legal or equitable action. The cost of such collection efforts, including but not limited to attorneys' fees, costs and expenses, will be charged to the customers account.

Pricing may differ from published website price due to occasional change in cost of goods and may not be reflected on the web page immediately. We do our best to show/honor prices listed on the site, however due to option prices changing regularly, pricing may need to be updated. We will not charge more than the listed price without first contacting you for approval.

Emergency Lighting accepts MasterCard, Visa, American Express and Discover.

Shipping

**If your shipment was damaged when you received it from the carrier, please have the delivery driver make a note as to start a "damaged in transit claim". This will allow for faster product replacement in the event that you do receive a damaged product.

To make buying from Emergency Lighting simple, shipping from multiple distribution centers, ordered items may arrive separately. Some of our vendors do not offer shipping with the US Postal Service and because of this, those shipments will be sent using UPS ground.

Attention: You are responsible for securing your package delivery location. If your package is shown to be delivered by UPS or USPS, you are responsible for the sale of those products. All products will be shipped with a tracking number to prove delivery to specified address.

Many products are ready to ship the same day you place your order. Once your order is placed, shipping date(s) will be e-mailed to you. In the event you do not see e-mail notification of your estimated ship date, please contact customer service. Emergency Lighting cannot deliver to P.O. Box locations.

As we attempt to provide the best possible customer service and timely delivery to our customers, Emergency Lighting will ship a substitute product of equal or greater quality. In cases of a shortage of products or a longer than expected delivery time or in the event the specific manufacture no longer produces a specific product, Emergency Lighting will provide the customer with a substitute product (if available) equivalent in quality or better.

In accordance with Emergency Lighting payment terms, items scheduled to ship within 30 days of the order date are charged at the time of the order. If your order was charged in full at the time of purchase and it is beyond 60 days, please contact Customer Service for a current status and billing adjustment.

*Fluorescent Lamps are shipped at the risk of the buyer, Emergency Lighting assumes no responsibility or liability for damage to Fluorescent Lamps during shipping.

Expedited Early A.M. Shipping

UPS Expedited Early A.M. Shipping can only be delivered to business addresses. The will not deliver to residential addresses until later in the day.

Flat Rate Shipping

The $9.99 Flat Rate Shipping applies to the lower 48 states. If your order is outside the lower 48 states we will contact you with shipping cost. These shipping costs will be calculated by using the lowest cost shipping method minus the flat rate fee of $9.99.

Sales Tax

Emergency Lighting collects sales tax on orders shipped to Minnesota and Illinois, as well as to other states in some cases of direct drop shipment from a local manufacturer. Buyer is responsible for sales or use tax within own jurisdiction.

Returns and Exchanges

If you are not satisfied with your purchase, please return it in its original, sellable condition. Emergency Lighting will issue a refund, excluding the actual original cost of shipping. $9.99 is a subsidized shipping amount and not the actual shipping cost. No undamaged merchandise will be accepted after thirty (30) days from delivery date. Credit will not be issued on used products. Clearance items are sold as is and are not subject to return. Products eligible for return must be new, unused, unaltered and contain all original product packaging and accessories. Products must be repackaged properly in the original packaging. Products not in original condition will not be accepted for return. No returned merchandise will be credited without a return authorization issued by Seller(*). Simply follow the instructions below:

  1. Please contact Emergency Lighting Customer Support at 763-292-5484 Monday through Friday, 9 am - 5 pm CT for a Return Authorization Number prior to returning the product. Products will not be accepted or refunded without a return authorization number.
  2. Indicate your return authorization number on the packing slip as well as clearly marked on the outside of the package to be returned. Make sure to include your packing slip with your return.
  3. Returns must be shipped prepaid and insured directly to Emergency Lighting Customer Service at:

  4. Once we receive your return in as new condition, your payment method will be refunded in 3 to 5 business days
Please contact Emergency Lighting regardless of the origin of the package. All returns must be delivered to the address above. Returns made to any other address may not be refunded or could result in additional fees. Handle all returns delicately.

Returns are subject up to 35% restocking fees of sale price. A reversal of payment on a credit card account will result in a 3% fee due to additional costs to Seller.

Please note that there are no returns on custom and made to order products as all these sales are final. If the return or exchange is due to an Emergency Lighting error or a damaged product, Seller will pay for the cost of shipping. Be sure to notify both the carrier and Emergency Lite Service Center within 24 hours of delivery to report a damaged package. Please keep all packing materials for use in the return.

Please allow two weeks for your return to be processed.
*PC Boards are not returnable and the sale is final.

Cancellations

**Once an order has been confirmed from the vendors Big Beam, Compass, DualLite, LightAlarms, Lithonia, or Philips Chloride the order cannot be canceled or returned.

Emergency Lite Service Center is doing everything it can to ship your items as quickly as possible and will make every attempt to cancel your order upon request. However, many of our products ship direct from the manufacturer and may be in the process of shipment when you make your request for cancellation.

In the event that you would like to cancel your order, Emergency Lighting will need to confirm with the individual manufacturer that your order has not been shipped. Once we have confirmation that your order has been cancelled, Emergency Lighting will credit your account. If Emergency Lighting is not able to cancel your order and it has already been shipped, please do not refuse the shipment as this could result in cancellation fees being assessed. All cancellation requests must be in writing and e-mail to info@emergencylighting.com. Emergency Lighting has established this privacy policy to explain to you how your information is protected, collected and used, which may be updated by Emergency Lighting from time to time. Emergency Lighting will provide notice of materially significant changes to this privacy policy by posting notice on the Emergency Lighting site.
